Why Clause 5 Is the Most Important Clause
Clause 5 is the most audited and most cited clause in ISO 45001. Under OHSAS 18001, safety could be delegated. ISO 45001 makes top management personally accountable.
Clause 5.1: Leadership and Commitment
Top management must demonstrate leadership by:
- OH&S discussed at board meetings (with minutes as evidence)
- Safety KPIs in senior management performance reviews
- CEO/MD visibly involved in safety activities
- Budget allocation for OH&S resources and training
What Auditors Actually Look For
- Interviewing top management — Can they articulate the OH&S policy? Do they know the current LTIFR?
- Reviewing meeting minutes — Is OH&S a standing agenda item?
- Checking resource allocation — Dedicated OH&S budget?
- Observing behaviour — Do managers wear PPE? Stop unsafe work?
- Performance reviews — Do managers have safety KPIs?
Clause 5.2: OH&S Policy
Must include commitments to:
- Provide safe and healthy working conditions
- Eliminate hazards and reduce risks
- Comply with legal requirements
- Consultation and participation of workers
- Continual improvement
Clause 5.4: Worker Participation
The standard distinguishes between:
Consultation (seeking views): policy, objectives, legal requirements, audit programme Participation (active involvement): hazard identification, risk assessment, control determination, incident investigation
8 Practical Worker Participation Mechanisms
- Safety Committees with worker majority and decision-making authority
- Hazard Reporting Systems — mobile app, suggestion boxes, direct access
- Risk Assessment Teams — workers assessing their own work areas
- Safety Walk Participation — workers accompany managers
- Toolbox Talk Development — workers develop and deliver
- Incident Investigation Teams — workers as contributors, not subjects
- Safety Improvement Suggestions — formal system with management response

| Mechanism | Evidence |
|---|---|
| Committee meetings | Minutes, attendance, decisions, action tracking |
