The Incident Investigation Crisis in South Africa

South Africa reports over 200 workplace fatalities annually and thousands of serious injuries. Behind each statistic is often a flawed investigation that blamed the worker instead of fixing the system.

The Department of Employment and Labour (DEL) increasingly scrutinizes investigation quality. Inspectors now look beyond the incident report — they want evidence of systematic root cause analysis and corrective action implementation.

    Why Most Investigations Fail

Research shows that 80% of workplace incident investigations suffer from:

    1. Blame culture — Concluding "the worker was negligent" and stopping there
    2. Shallow analysis — Identifying immediate causes but missing systemic failures
    3. No methodology — Investigators lack structured investigation frameworks
    4. Poor evidence collection — Critical evidence lost in the first 24 hours
    5. Weak corrective actions — Generic recommendations like "retrain workers"

    Professional Investigation Methodologies

    1. The 5 Whys Technique

Start with the incident and ask "why?" five times to drill down to root causes:

    • Why did the worker fall? → The scaffolding collapsed
    • Why did the scaffolding collapse? → It wasn't inspected before use
    • Why wasn't it inspected? → No inspection protocol exists
    • Why is there no protocol? → Management hasn't allocated resources to scaffold safety
    • Why haven't they allocated resources? → OHS isn't integrated into operational planning

Root cause: Lack of management commitment to OHS integration (not "worker error").

    2. Fishbone (Ishikawa) Diagram

Categorize contributing factors across six domains:

    • People — Training, competence, supervision, fatigue
    • Process — Procedures, work instructions, permit systems
    • Plant/Equipment — Maintenance, guarding, suitability
    • Place — Housekeeping, lighting, ventilation, access
    • Policy — Management commitment, resource allocation, communication
    • Performance — Monitoring, auditing, review mechanisms

    3. Tripod Beta

A sophisticated methodology that traces incidents back through:

    • Active failures (immediate unsafe acts/conditions)
    • Preconditions (underlying factors enabling the failure)
    • Latent failures (management and organisational deficiencies)

Legal Requirements for Incident Investigation in SA

The OHS Act and General Safety Regulations require:

    • Section 24 — Recording and investigating incidents
    • GAR 8 — Reporting incidents to the Provincial Director
    • GAR 9 — Investigation of serious incidents by an inspector
    • COID Act — Reporting to the Compensation Commissioner within 7 days

Failure to investigate adequately can result in:

    • Criminal prosecution under the OHS Act
    • Increased Workmen's Compensation levies
    • Civil liability for negligence
    • Department of Labour prohibition notices
