    Falls: Construction's Deadliest Hazard

Falls from height account for approximately 30% of all construction fatalities in South Africa. Despite clear regulatory requirements, many construction sites operate with inadequate or non-existent fall protection plans.

The Construction Regulations (2014), specifically Regulation 9, mandate that every construction site where work is performed at a height of 2 metres or more must have a documented fall protection plan.

    Regulation 9: The Legal Requirements

    What the Regulation Requires:

    1. A fall protection plan developed by a competent person before work at height commences
    2. The plan must be site-specific — generic templates don't satisfy the legal requirement
    3. Workers must be trained on the fall protection plan before starting work
    4. Fall protection equipment must comply with SANS standards
    5. Regular inspections of all fall protection equipment and anchor points

    Who Is a "Competent Person"?

The Construction Regulations define a competent person as someone who:

    • Has appropriate qualifications (NQF Level 4 or above in a relevant field)
    • Has been trained in fall protection plan development
    • Has practical experience in fall protection systems
    • Is designated in writing by the contractor

Components of a Fall Protection Plan

A compliant fall protection plan must include:

    1. Site Assessment

    • Identification of all areas where work at height will occur
    • Height measurements and duration of exposure
    • Environmental factors (wind, rain, lighting)
    • Access and egress routes

    2. Risk Assessment

    • Hazard identification for each elevated work area
    • Risk rating using likelihood × severity matrix
    • Edge protection requirements
    • Fragile surface identification

    3. Control Measures (Hierarchy)

    • Eliminate: Can the work be done from ground level?
    • Guardrails: Fixed edge protection systems
    • Travel restraint: Prevents workers reaching the edge
    • Fall arrest: Catches workers who fall (harnesses, lanyards, lifelines)
    • Fall containment: Safety nets, airbags
    • Administrative: Permit systems, supervision, training

    4. Equipment Specifications

    • Full body harness: SANS 50361
    • Lanyards: SANS 50354
    • Anchor points: Minimum 22kN strength rating
    • Safety nets: SANS 1636
    • Guardrails: Minimum 900mm height, capable of withstanding 1.25kN

    5. Rescue Plan

    • Procedures for rescuing a suspended worker within 6 minutes
    • Trained rescue team identified
    • Rescue equipment specified and available
    • Emergency services contact details

    6. Training Records

    • All workers trained on the specific fall protection plan
    • Equipment inspection competence verified
    • Refresher training schedule

    Common Non-Compliance Issues

The Department of Labour frequently cites construction sites for:

    1. No fall protection plan at all — Immediate prohibition notice
    2. Generic plan not site-specific — Doesn't satisfy Regulation 9
    3. Untrained workers working at height
    4. Expired or damaged equipment still in use
    5. No rescue plan — particularly dangerous as suspended workers can die within minutes
    6. No competent person appointed in writing

    Penalties

Non-compliance with Regulation 9 can result in:

    • Prohibition notice — All work at height stops immediately
    • Contravention notice — Fine and corrective action deadline
    • Criminal prosecution — If a fatality or serious injury occurs
    • Civil liability — Negligence claims from injured workers
